House falls short on constitutional amendment to lock Supreme Court at nine justices
The House on September 2, 2026 rejected a proposed constitutional amendment that would require the Supreme Court of the United States to be composed of nine justices.
The joint resolution would have written the Court's current size into the Constitution, removing Congress's ability to change the number of seats by ordinary legislation.
The House considered the measure under a motion to suspend the rules and pass it, a procedure that requires the support of two-thirds of those voting. Members voted 212 to 206 in favor, with 15 not voting. That was a majority but short of two-thirds, so the resolution failed.
