Mr. Mast introduced the following bill; which was referred to the Committee on Veterans' Affairs
To amend the Servicemembers Civil Relief Act to preempt any squatter’s rights established by State law regarding real property owned by a member of the uniformed services.
Section 1. Servicemembers Civil Relief Act: preemption of squatters’ rights
(a) Preemption
The Servicemembers Civil Relief Act (54 Stat. 1178; 50 U.S.C. 3901 et seq.) is amended by inserting, after section 301, the following new section:
301A. Preemption of squatter’s rights
Any State law establishing squatter’s rights shall not apply to premises—
(1)
owned by a servicemember; and
(2)
occupied by a squatter during a period of military service of such servicemember.
(b) Clerical amendment
The table of contents in section 1(b) of such Act (50 U.S.C. 3901(b)) is amended by inserting after the item relating to section 301 the following new item:
