Ms. Underwood (for herself, Mr. García of Illinois, and Mr. Takano) introduced the following bill; which was referred to the Committee on Transportation and Infrastructure, and in addition to the Committee on the Judiciary, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned
To require the Architectural and Transportation Barriers Compliance Board to finalize a proposed rule relating to accessibility of electric vehicle charging stations, and for other purposes.
Section 1. Short title
This Act may be cited as the EV Charging Accessibility Act
.
Sec. 2. Rulemaking to adopt recommendations for accessibility of electric vehicle charging stations
(a) In general
Not later than 18 months after the date of the enactment of this Act, the Architectural and Transportation Barriers Compliance Board shall finalize the proposed rule issued on September 3, 2024, and titled American With Disabilities Act and Architectural Barriers Act Accessibility Guidelines; EV Charging Stations
(89 Fed. Reg. 71215).
(b) Requirements
The Architectural and Transportation Barriers Compliance Board shall include in the final rule required under this section the minimum standards for electric vehicle charging stations (as the term charging station
is defined in section 680.104 of title 23, Code of Federal Regulations) and accessibility guidelines for such stations.
(c) No delay in finalizing rule
If, upon the expiration of the deadline described in subsection (a), the Architectural and Transportation Barriers Compliance Board has not finalized the rule required under this section, the proposed rule described in subsection (a) shall be deemed to be a final rule, and a notice of such final rule shall be promptly published in the Federal Register.
(d) Adoption of regulations
Not later than 180 days after a final rule is published pursuant to subsection (a), the Secretary of Transportation and the Attorney General shall issue such regulations as are necessary to adopt such guidelines.
