Mrs. Blackburn (for herself and Mr. Hagerty) introduced the following bill; which was read twice and referred to the Committee on Environment and Public Works
To amend the Tennessee Valley Authority Act of 1933 to provide that the Federal Reports Elimination and Sunset Act of 1995 does not apply to certain reports required to be submitted by the Tennessee Valley Authority, and for other purposes.
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,
Section 1. Short title
This Act may be cited as the Tennessee Valley Authority Salary Transparency Act
.
Sec. 2. Salary disclosure; exception to report elimination
(a) In general
Section 9 of the Tennessee Valley Authority Act of 1933 (16 U.S.C. 831h) is amended—
(1)
by striking the section designation and all that follows through (a) The Board
in subsection (a) and inserting the following:
9. Financial reporting
(a) Report on compensation
(1) In general
Except as provided in paragraph (2), the Board;
(2)
in subsection (a)—
(A)
in paragraph (1) (as so designated), by striking a financial statement
in the first sentence and all that follows through the period at the end of the second sentence and inserting a report describing the total number of employees of the Corporation at the management level or above (including all executives and Board members), including the name, salary, and duties of each such employee, that are receiving compensation equal to, or greater than, the maximum rate of basic pay for grade GS–15 of the General Schedule.
; and
(B)
by adding at the end the following:
(2) Exemption
Any information relating to salaries of employees of the Corporation contained in, or filed with, a report under paragraph (1) shall be exempt from—
(A)
disclosure under section 552(b)(3) of title 5, United States Code; and
(B)
the requirements of the Access to Congressionally Mandated Reports Act (44 U.S.C. prec. 4101 note; Public Law 117–263).;

in subsection (b), by striking (b) All
and inserting the following:

in subsection (c)—
(A)
in the first sentence—
(i)

(b) Conforming amendment
Section 14 of the Tennessee Valley Authority Act of 1933 (16 U.S.C. 831m) is amended, in the last sentence, by striking and in addition to the statement of the cost of power
and all that follows through for the sale of power
.
